Can it be a 1031?

General information only, not tax or legal advice. The IRS looks at your intent and the full facts. Ask a CPA and your Qualified Intermediary before you list.

Common mistake: "I rented it a few weekends, so my vacation home is a rental." Not by itself. The IRS safe harbor wants 24 months of ownership, at least 14 days a year at fair rent, and personal use no more than 14 days or 10% of rented days.

Next steps

  1. It qualifies? Run the money side: gain, boot and your 45/180-day dates in T27.
  2. Not sure which kind of 1031 fits (delayed, reverse, DST)? T228.
  3. Used to live there? §121 and §1031 can work together: T224.
  4. Pick a Qualified Intermediary before the sale closes: T226. Then follow the dated checklist: T227.
